Effective status: Draft pending owner and legal review. These terms describe the proposed scope of NDKA diagnostic services. They are not a substitute for a signed engagement agreement.
What is included
The Clarity Scan ($100) provides a one-page assessment of one publicly accessible brand asset and up to three clarity gaps with one priority action. The Positioning Brief ($150) covers a homepage and one additional customer touchpoint, providing a two-to-three-page analysis, value proposition/CTA suggestions and three recommendations. The Growth Case File ($200) covers the homepage, up to two additional touchpoints and one inquiry path, providing a four-to-five-page diagnostic, 30-day test roadmap and a 15-minute findings review.
What is not included
Packages exclude implementation, design files, unlimited revisions, extensive original research, confidential third-party data collection, legal advice, assurance of regulatory compliance and guaranteed commercial results. Custom engagements require separate written proposals and contracts.
Purchase and intake
The proposed process is payment through a secure hosted checkout followed by a diagnostic intake. Work begins only after payment is verified, intake is complete and scope is accepted. Never send passwords or sensitive personal data through the intake. Requested turnaround must be agreed and confirmed in writing, not assumed from purchase date.
Revisions and corrections
The proposed introductory packages cover factual corrections within seven calendar days of delivery, but not additional assets, strategy changes or expanded scope. Errors caused by inaccurate materials furnished by a client may require a separate engagement.
Cancellation and refunds — owner approval required
Proposed policy: Before substantive diagnostic work begins, a customer may request cancellation and a full refund. After substantive work begins, refunds should be handled proportionately to work already performed and applicable law. If NDKA cannot fulfill an accepted order, a refund or agreed alternative should be offered. This wording must be confirmed against the selected payment processor's dispute rules and applicable law before accepting payments.
Confidentiality, ownership and records
NDKA should use customer materials solely to evaluate and fulfill the agreed service, restrict access to what is necessary, and not publish client information or proprietary findings without written permission. Clients must confirm they have authority to provide any submitted materials. Unless agreed otherwise, clients retain ownership of materials they supply. Final diagnostic deliverables may be used internally by the purchasing client, with NDKA retaining its pre-existing methods and templates; final intellectual-property language must be included in the approved agreement.
Results and limitations
NDKA identifies observed evidence, reported facts, inferences and missing information. Diagnostic findings are professional opinions based on a limited, disclosed scope. Results are not warranties of performance, product-market fit, sales conversion or revenue. NDKA may decline work requiring deceptive marketing, unlawful activity or abusive conduct.
Disputes and governing terms
Applicable law, entity identity, formal notices, dispute procedures, fee recovery and any limits on liability must be reviewed and completed by qualified North Carolina counsel before binding commercial use.
